The appellees were the plaintiffs in the suit in the nature of ejectment, and claimed title to the lands sought to be recovered through Martin H. Lay. The defendants deduced their title from the same source. They admitted that the plaintiffs were the heirs or devisees of the said Lay, but they defended on the ground that they had purchased the lands at a valid sale made by the administrator of Day’s estate under a decree of the probate court, and that the sale had been confirmed by the court, and a proper conveyance made to them by the administrator, under its order.
