TUCKER, Judge.

In this suit plaintiff, Alex Briley, seeks to recover from the defendant, Union Central Life Insurance Company, the policy principal of one thousand two hundred fifty and no/100 ($1,250.00) dollars, plus a penalty in like sum and twelve (12%) per cent interest on the composite sum for the arbitrary refusal on the part of the defendant to make payment to the plaintiff under the company’s Policy No. 56412424 designated “Special Industrial Accident Policy”, issued on the life of one Robert Briley with plaintiff the named beneficiary thereunder.
