Appellant was charged with breaking and entering a dwelling house with intent to commit a felony, to wit: rape. The crime occurred on the 28th of May 1967 and the information was filed on June 1, 1967. A jury returned a verdict of guilty as charged on the 6th day of September, 1967. The defendant attempted to appeal his judgment and sentence and signed his notice of appeal, (which was filed in proper person) on December 2, 1967 or within the 90 day appeal time.
