In a proceeding pursuant to CPLR article 78 to review a determination of the State Commissioner of Social Services, dated August 31, 1977 and made after a statutory fair hearing, which affirmed a determination of the local agency to terminate petitioner’s aid to dependent children benefits, the State commissioner appeals from a judgment of the Supreme Court, Orange County, entered December 12, 1977, which, inter alia, granted the petition.
