Ap*780peal from a judgment of the County Court of Rensselaer County (McGrath, J.), rendered March 11, 1999, convicting defendant upon his plea of guilty of the crime of sexual abuse in the first degree.

Defendant pleaded guilty to the crime of sexual abuse in the first degree in full satisfaction of a three-count indictment. As part of the negotiated plea arrangement, it originally was agreed that defendant would receive a sentence of time served and five years’ probation provided he successfully completed a program in a residential drug and alcohol treatment facility.
