HENDERSON, Judge.

Appellant was convicted of murder in the second degree, and his punishment assessed at confinement in the penitentiary for a term of thirty-five years; and appeals.

A brief statement of the case shows that appellant (Green) and deceased (Ore) were neighbors, living two or three miles from Mt. Pleasant. The homicide occurred on Sunday at the home of appellant. The appellant’s home (where he and his wife lived) was about 100 yards from appellant’s father (A. L. Green).
