Under a decree of the circuit court for the Southern district of Illinois and the district of Indiana, made in the summer of 1877. and an amendment made to that decree in May, 1878. in both of these courts, the. main line of the Indianapolis, Bloomington & Western Railway Company was sold by the master in chancery of each court. DRUMMOND, Circuit Judge.
The first exception is that the court had' no jurisdiction of the case, and therefore the decree was void. Under the circumstances, I can scarcely consider this an open question. The cases were originally brought in the state courts of Illinois and Indiana, and were transferred, under the act of congress of 1875 LIS Stat. 470], to the circuit courts of the United States for the Southern district of Illinois and the district of Indiana.
