The defendants Nicholson and Mitchell (defendants) together with one King,2 were convicted of rape, armed robbery, armed assault in a dwelling, and assault and battery by means of a dangerous weapon after a joint trial pursuant to G. L. c. 278, §§ 33A-33G. The judge sentenced the defendants to life terms on all but the last of those convictions. The indictments for assault and battery by means of a dangerous weapon were placed on file with the consent of the defendants.

The jury heard testimony that the defendants and King forced their way into a Boston apartment occupied by a single woman.…
