The facts alleged in petition necessary to an understanding of the questions presented are these: January 2, 1923, the board of county commissioners of Muskogee county employed the plaintiff as tax ferret for a period of two years. August 7, 1923, they employed the defendant W. I\ Blakemore as tax ferret for a period of one year from that day.
