delivered the opinion of the court:

The plaintiff in error, Christian Lee, was tried and convicted at the May term, 1910, of the Livingston county circuit court on an indictment charging him with mingling carbolic apid with beer, with an intent to cause the death of Emma Lee, his wife, in violation of section 230 of the Criminal Code, which makes it a felony to mingle any poison with food, drink or medicine with an intent to cause the death of any person.
