Appeal by the defendant, Isidor Beiley, from an order of the Supreme Court, made at the New York Special Term on the 28th day of November; 1913, and entered in the office of the clerk of the county of New York, granting plaintiff’s motion for a discovery and inspection of defendant’s books.

The petition alleges that the action is brought to recover $1,710, as commission as a salesman of petticoats and bathing suits for defendant upon an oral agreement whereby it was agreed that the defendant would employ petitioner from January 1, 1913, until July 1, 1913, and agreed to pay petitioner four per cent of the gross amount of goods sold and delivered by defendant to customers procured by petitioner during said term, and to pay the sum of $30 per week as a drawing account, the aggregate amount of which was to be deducted from the aggregate amount of commissions earned by…
