— Appeal from a judgment of the County Court of Chemung County (Hayden, J.), rendered May 4, 2001, convicting defendant upon his plea of guilty of the crime of assault in the first degree.
In August 2000, defendant attacked an acquaintance with a serrated kitchen knife, inflicting cuts to the victim’s head, chest and back, and causing him to jump from a second story porch, resulting in a compound fracture to his leg. The victim later had to have his leg amputated. As a result of this incident, defendant was charged with assault in the first degree and pleaded guilty to this crime in exchange…
