Affirming.

Michael Cary, a resident of Owensboro, died on November 4,1922. At the time of his death he was 81 years of age, and possessed a large estate, consisting of cash, securities and a great many small houses. He left a will dated May 5,1920. When the will was made he had only one daughter, Bertha C. Bennett, one grandson, Cary Bennett, the son of his daughter, and two great-grandsons, Cary Bennett, Jr., and William Francis Bennett, who were the children of Cary Bennett, and who were only five and seven years old, respectively.
