Appeal by the defendant from a judgment of the Supreme Court, Kings County (Lagaña, J.), rendered August 14, 1989, convicting -him of murder in the second degree, and rape in the first degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed.

The defendant argues that the court should have sua sponte charged the jury on circumstantial evidence regarding the intentional murder count, since there was no direct evidence in support of that charge.
