From the record in this cause, it appears that a summons of garnishment was sued out at the instance of Sullivan & Black, who were judgment creditors of James Kirkpatrick, returnable to the August Term of Cass Superior Court, in the year 1844, and was duly served on Moses Stroup the plaintiff in error, requiring him to depose and answer what he was indebted to said Kirkpatrick, according to the provisions of the statute in such cases made and provided.
