This was an action of forcible detainer, brought by the appellee against the appellant before a justice of the peace of Stark county, to recover the possession of a certain tract of land therein situate. A verdict and judgment having been rendered for the plaintiff, an appeal was taken to the Circuit Court, where, on a trial by jury, a verdict was given for the plaintiff. A motion for a new trial was entered, for the reasons: 1. That the verdict was against law. 2. Was against the evidence. 3. The court gave improper instructions on behalf of plaintiff.
