The declaration in this case sets forth that the defendant, by his agent, assigned to the plaintiff a certain contract theretofore entered into between the defendant and one Raube for the purchase of a bond and mortgage made by one Thomas K. Moore, which was a valid lien for $7,500, besides interest, upon lands in the city of New York, of which the defendant was then the owner; that lire agreement between the plaintiff and defendant provided, among other tilings, that, in the event of the plaintiff’s taking an assignment of said bond and mortgage under said…
