[This was a suit originally brought in a state court of New York by Samuel McLean against'the St. Paul & Chicago Railway Company, for breach of contract. It was removed to this court on motion of defendant, and is now heard on motion of plaintiff to remand to the state court.]

BLATCHFORD. Circuit Judge.

On the 7th of February, 1879, this suit was commenced in the court of common pleas for the city and county of New York, by the service of a summons. A complaint was aft-erwards put in in the state court, which demands judgment against the defendant for $105,000 and interest, for breach of a contract. The complaint, which is sworn to February 27th, 1879, sets forth that the plaintiff “is a resident of the city of Brooklyn, county of Kings and state of New York.” The defendant is a corporation created by the state of Minnesota.
