CHRISTIAN, Judge.
The offense is murder; the punishment, confinement in the penitentiary for ten years.
It was charged in the indictment, in substance, that appellant, with malice aforethought, killed Joe Edmondson by beating him with a pistol.
The homicide occurred at night in appellant’s apartment. When officers arrived at the scene they found deceased’s body. His head and face had been beaten into a pulp.
