These are consolidated Georgia diversity cases arising out of a highway accident involving three cars and a truck. Mr. and Mrs. Weber were occupants of one car. Each of them filed suit in Georgia state court against these parties: DeWitt Trucking, owner of the truck and holder of a certificate of public convenience and necessity from the Georgia Public Service Commission; Mills, DeWitt’s driver; The Insurance Company of North America [INA], DeWitt’s insurer; and Gates, driver of a second car.
