McMurray and Brother and others, from a judgment of the Supreme Court in favor of certain of the defendants, entered in the office of the clerk of the county of Kings on the 23d day of August, 1909,. upon the decision of the court rendered after a trial at the Kings County Special Term, and also from an order entered in said clerk’s office on the 4th day of November, 1909.

"Plaintiff and the defendant-appellants seek to enforce against the real property owned by the defendant-respondents mechanics’ *732liens, tiled by them respectively, upon the ground -that they have performed labor or furnished materials for the improvement thereof, with the consent of said owners.
