New York Supreme Court
1Opinion of the Court
OPINION OF THE COURT
Peter J. Benitez, J.
Defendant was tried before this court and a jury and found guilty of sexual abuse in the second degree, criminal sexual act in the first degree and endangering the welfare of a child. Defendant has moved to set aside the verdicts.
Defendant moves to set aside the verdicts on several grounds. Defendant contends that the verdicts of guilty on sexual abuse in the second degree and criminal sexual act in the first degree are repugnant to other verdicts of the jury and further that those verdicts violate his protection against double jeopardy.
