Z. L. Cason was employed by appellants as helper to one of their machinists, and while engaged in the act of repairing one of their engines in the machine shops at Fort Worth in some way his foot slipped or rolled, and he was precipitated into the ashpit, receiving injuries fqr which he recovered judgment in Lhe sum of five thousand dollars. Inasmuch as we have decided to reverse and remand the cause because there was no evidence to show negligence on the part of appellants, we will set out the entire statement of appellee in reply to appellant’s assignment raising…
