This is an action for damages instituted by appellees as brothers and sisters of Douglas Boone, deceased, for' the alleged wrongful and negligent killing of the de*653ceased by appellant railway company. Douglas Boone at the time of the unfortunate tragedy was a soldier in the United States army, and stationed as one of the guards at Brooklyn bridge on the line of the defendant company. On April 8, 1917, a detachment of soldiers was detailed to guard the railway bridge across Black creek. This detachment consisted of a sergeant, two corporals, and eight privates.
