This case is pending on several motions, including defendant Secretary Shalala’s motion to dismiss defendants other than the Secretary of the Department of Health and Human Services, and the Secretary’s motion for summary judgment, as well as the plaintiffs cross-motion. No oral hearing is deemed necessary. Local Rule 105.6, D. Md.
