The plaintiff brings this action of tort under the Federal employers’ liability act, U. S. C. (1940 ed.) Title 45, §§ 51-60, for the death of her husband, an employee of the defendant, who lost his life during a fire in the defendant’s freight shed in Salem on June 2, 1944.1 The jury returned a verdict for the plaintiff, and the only question for decision is whether the judge erred in denying the defendant’s motion for a directed verdict.2 It is agreed that the deceased was an employee of the defendant, a common carrier by railroad, and that at the time of his death his employment was in…
