Berger, J.,

This is an injunction bill, in which the hearing on the rule to continue or dissolve the preliminary injunction granted to restrain threatened and repeated acts of trespass was waived and the injunction continued by the agreement of the parties until final hearing. The defendants, in their answer to the bill filed Aug. 9', 1924, incorporated therein allegations as a foundation for affirmative relief against the plaintiff, under a caption entitled “Cross-bill,” to which the plaintiff filed a demurrer, which was overruled for the reasons stated in Schumacher v. Ploplis, 5 D. & C.…
