Baird, P. J.,

The defendants in this case were indicted as Supervisors of Wayne Township for failure to keep in repair a certain public road therein.

When the defendants were called upon to plead, their counsel moved to quash the indictment for the reason that the offence therein charged is not the subject of indictment in the Quarter Sessions. Being put to the alternative of refusing the motion, with little time for its consideration without delaying the other business of the court, or continuing the case in order to afford ourselves the opportunity for that careful and leisurely examination…
