The above case came before the court at Duluth, Minnesota, on March 16, 1970 on the motion of defendants Clifford Hardin, Secretary of Agriculture, Edward P. Cliff, Chief of United States Forest Service, and Craig Rupp, Forest Supervisor, Superior National Forest (the federal defendants) to dismiss the action as to the three of them on the grounds (1) that the complaint fails to state a claim against them upon which relief can be granted; (2) that this is a suit against the United States to which it has not consented and the court therefore lacks jurisdiction; and (3)…
