Cheyenne Pate was convicted by jury of burglary of a habitation. See Tex. Pen. Code Ann. § 30.02 (Vernon 1994 & Supp. 1998). During the punishment phase of the trial, Pate pled true to the two enhancement allegations pled in the indictment and punishment was set by the court at 32 years’ confinement in the Institutional Division of the Texas Department of Criminal Justice.
