In a proceeding pursuant to CPLR article 78 to compel the respondent to furnish the petitioner with a copy of his presentence report, the petitioner appeals from a judgment of the Supreme Court, Dutchess *489County (Jiudice, J.), dated June 4, 1985, which, after a hearing, dismissed the proceeding on the merits.

Ordered that the judgment is affirmed, without costs or disbursements.
