— In a medical malpractice action, the plaintiffs appeal from (1) an order of the Supreme Court, Westchester County (Ferraro, J.), entered May 20, 1985, which granted the defendant’s motion to dismiss the complaint for want of prosecution pursuant to CPLR 3216, and (2) a judgment of the *359same court, dated May 30, 1985, which dismissed the action with prejudice.

Ordered that the appeal from the order entered May 20, 1985 is dismissed; and it is further,

Ordered that the judgment is affirmed; and it is further,

Ordered that the defendant is awarded one bill of costs.
