Stewart and husband, residents of Sioux Falls, South Dakota, entered into a contract in writing with the defendant, a resident of Carroll, Iowa, agreeing to convey to him Section 23, Township 110, Range 65, Beadle County, South Dakota, for a consideration of $30,001, $1.00 of which was paid at the time of the execution of the' contract.
