The controlling question in this case is which of two sections of Shannon’s Code declared the offense and *385fixed the punishment for a crime charged against John Carter by indictment at the November term of the circuit court of Henry county, for the year 1911, upon which he was tried and convicted by a jury at the November term, 1912.

Upon Carter’s appeal therefrom, the judgment based on the above conviction was affirmed by us at our April term, at Jackson, in 1913, and Carter was committed to the penitentiary to serve out the term of four years imposed by the verdict of the jury. In August,…
