OPINION

NYE, Chief Justice.

Appellant, Connie Lee Mumphord, filed this suit against appellee, First Victoria National Bank (Bank), and Neumann’s Food Store, Inc. of Victoria, Texas (Neumann’s), for damages and to set aside a foreclosure sale to Neumann’s by the trustee for the Bank of certain property originally owned by Mumphord. At the close of Mumphord’s case in chief, the trial judge directed a verdict in favor of Neumann’s.
