PUTNAM, Circuit Judge.

This case came up originally on a motion to dismiss, which the court declined to hear in that form on account of the difficulty and importance of the questions involved. By; *817consent of the court the same was converted into a demurrer to the first, second, and third counts.

One question relates to the extraterritorial force of rights of action given by statute, and this in its general aspect is settled favorably to the plaintiff by the supreme court in the line of cases ending with Huntington v.
