MAJOR, Circuit Judge.

Plaintiffs named in the caption brought this action against the United States under the Federal Tort Claims Act, 28 U.S.C.A. §§ 1348, 2871 et seq., to recover damages for personal injuries allegedly sustained as a result of negligence on the part of a government employee acting within the scope of his employment. Prior to trial the action was dismissed as to Gomez. On May 31, 1956, Honorable William J.
