This is an action in assumpsit, brought by Horace G. Stone (since deceased, and his executrix, Louise Stone Hubbard being substituted in his stead) against the defendants, J. Edgar Settles and Homer Shaw, upon a promissory note dated April 1, 1918, and upon a written agreement of extension of the note, dated August 1, 1921. After summons had been issued and served, and a declaration filed, the court, on February 8, 1923, upon the defendants’ default, entered judgment for the plaintiff against the defendants in the sum of $7,041.21 and costs.
