—Appeal by the People (1), as limited by their brief, from so much of an order of the Supreme Court, Queens County (Chetta, J.), dated October 26, 2000, as granted that branch of the defendant’s motion which was to impose a sentence of five years’ probation, and (2) from an amended judgment of the same court, rendered December 21, 2000, which, upon sua sponte reducing the defendant’s conviction from assault in the first degree to assault in the second degree, imposed a sentence of five years’ probation, upon remittitur from this Court (see People v Meneses, 195 AD2d 527 [1993]).
