OPINION

FEDERICI, Justice.

This case is a direct appeal from the defendant-appellant’s (defendant) Juan L. Baca’s conviction of first degree murder. On April 26,1979, the defendant was indicted for the shooting death of Toby Baca. Joe “Shuske” Baca, not a party to this appeal, was indicted for aiding and harboring the defendant. The defendant was convicted of the first degree murder of Toby Baca. That conviction was appealed and this Court reversed the trial court and remanded the case for a new trial. State v. Baca, 97 N.M. 379, 640 P.2d 485 (1982). In September, 1982, defendant was retried.…
