— In an action to recover damages for personal injuries, etc., the plaintiff Jack Cotter appeals, as limited by his brief, from so much of a judgment of the Supreme Court, Westchester County (Gurahian, J.), dated August 21, 1986, as, upon a jury verdict, is in favor of the defendant and against him.

Ordered that the judgment is reversed insofar as appealed from, on the law and the facts and as a matter of discretion, and a new trial is granted to the appellant, with costs to abide the event.
