INTRODUCTION

This appeal involves a matter of first impression in Pennsylvania stemming from an assault and battery inflicted by a stock trader (Ralph DiDonato) against another stock trader (William J. Dooner) while employed at the Philadelphia Stock Exchange (PSX). As a result of the attack, plaintiff-husband and his wife, Maureen Dooner, filed on May 28, 2004, a civil action against defendant DiDonato and defendant PSX averring counts of assault and battery, negligence, negligent supervision, intentional infliction of emotional distress and punitive damages.…
