On June 15, 1909, the board of aldermen of the city of Salem, on petition of the Boston and Northern Street Railway Company (the predecessor in title of the Eastern Massachusetts Street Railway Company), adopted an order permitting the company to build a track on Mason Street, a public way in that city. On July 31, 1924, an order was passed by the city council which reads as follows: “That the public necessity and convenience in the use of *44Mason Street, a public way in the City of Salem, requires that the location for a track and curve granted to the Boston and Northern Street Railway Company…
