OPINION

BUSSEY, Presiding Judge:

Appellant, John Hubert Brown, hereinafter referred to as the defendant, was charged in the District Court, Muskogee County, Case No. CRF-76-282, with the offense of Larceny of a Motor Vehicle, After Former Conviction of a Felony, in violation of 21 O.S.1971, § 1720. He was tried by a jury, convicted of the lesser included offense of Unauthorized Use of a Motor Vehicle, After Former Conviction of a Felony, in violation of 47 O.S.1971, § 4-102 and sentenced to imprisonment in the state penitentiary for a term of twenty-five (25) years.
