Plaintiff, Orrin C. MacCurdy, instituted this proceeding in equity to restrain Louie H. Filer, one of de fendants, from selling and Joseph A. Lindey and wife, the other defendants, from purchasing the interests of said Louie H. Filer in a written contract granting the right to mine and remove certain minerals in and under plaintiff’s land in Brady Township, Butler County; and also to have the contract declared to be null and void because of abandonment. From the final decree dismissing the bill of complaint, plaintiff has appealed.
