This action was commenced against the firm of Hoffman, Gelpcke & Co., bankers, doing business in Chicago, Illinois, to recover a firm debt. Moneys belonging to the firm were attached in New York, and service made by publication, after which the defendants appeared generally in the action, and made a motion to dismiss the complaint and vacate the attachment on the ground that one of the members of the firm, Hoffman, was a consul for the Grand Duchy of Saxe Coburg Gotha, duly recognized by the government of the United States.
