WOLLMAN, Circuit Judge.
Appellant, T.J. Hayes, was found guilty by a jury of capital felony murder, Ark. Stat.Ann. § 41-1501 (Repl.1977). The jury recommended a sentence of death by electrocution. The conviction was reversed by the Arkansas Supreme Court, and a new trial was ordered on the ground that the trial court should have allowed defense counsel access to records of Hayes’ court-ordered psychiatric and psychological examinations. Hayes v. State, 274 Ark. 440, 625 S.W.2d 498 (1981). Hayes was retried and again was found guilty of capital murder and sentenced to death. The Arkansas…
