Lewis, Justice.
The plaintiff brought this action to recover benefits provided under a policy of disability insurance issued to him by the defendant. The defendant denied liability contending that the plaintiff made fraudulent misrepresentations in procuring the issuance of the policy and, subseuently, in obtaining its reinstatement after it had lapsed for nonpayment of premiums. During the trial of the case both parties made timely motions for a directed verdict, each contending that the evidence conclusively resolved the foregoing issue in its favor.
