The plaintiff, Sam D. Daniel, owned a Ford automobile on which he held an insurance policy issued by the defendant company, insuring him against loss of the car by theft, robbery or pilferage, except by a person or persons in the assured’s household or in his service or employment.

On the afternoon of September 12, 1926, Daniel parked his car on Fisk street in the City of Alexandria and went to a picture show.
