This personal injury action arises out of an intersection collision between a dump truck driven by defendant Drury and a pickup truck driven by defendant Westberry. Plaintiff James Loper was a passenger in Westberry’s truck. Loper and his wife filed this action naming as defendants Westberry and Drury, Drury’s employer and his employer’s wife, and the state Department of Transportation (DOT). Parties were added and dismissed in the course of litigation, and the defendants at trial were Westberry, Drury, Drury’s employer and his common carrier insurer, the DOT, and twelve DOT…
